Welcome to the website of Nanny Genie.

These Website Terms & Conditions govern your use of the Platform and form a binding contract between Nanny Genie and yourself. These Website Terms & Conditions must be read in conjunction with the Privacy Policy, Ethical Considerations and Eligibility Criteria.

By accessing the Platform, you confirm that you are at least twenty one (21) years of age, which is the legal age to form a binding contract. In using the Platform, you provide us with your unconditional consent to be bound by these Website Terms & Conditions. Please be aware that your current and future use of the Platform is subject to the terms hereunder, as may be updated from time to time.

The following definitions apply to these Website Terms & Conditions:

Eligibility Criteria means a document containing rules and regulations regarding your eligibility to avail Nanny Connecting Services;
Ethical Considerations means a document containing considerations for you to implement for the entire duration of availing Nanny Connecting Services;
Force Majeure Event means an occurrence beyond the control of Nanny Genie, preventing it from fulfilling its obligations under these Website Terms & Conditions;
Nanny/Nannies means individuals who are seeking matching for Nanny Connecting Services through Nanny Genie;
Nanny Genie means Nanny Genie Portal, an entity incorporated under the laws of Dubai, UAE, with email address [email protected];
Nanny Connecting Services means the services provided by Nanny Genie to assist families in finding and connecting with qualified nannies for their child care needs. These services include the facilitation of nanny recruitment, screening, and selection processes;
Platform means the online website of Nanny Genie accessible with the URL https://nannygenie.com/;
Privacy Policy means the Privacy Policy pertaining to the Platform;
Website Terms & Conditions means these Website Terms & Conditions governing your use of the Platform;
UAE means the United Arab Emirates;
Us/Our/We refers Nanny Genie and its affiliates, subsidiaries and related entities; and
You/Your/(similar reference) refers to you as the user of the Platform or individuals that avail Nanny Connecting Services.

1. USE OF PLATFORM

We are not a recruitment firm nor a hiring agency. We merely provide Nanny Connecting Services and it is your responsibility to hire any matched Nanny subject to applicable laws.

Subject to your compliance with these Website Terms & Conditions, we grant you a limited, non-exclusive and non-transferable right to access and use the Platform solely for and in connection with procuring Nanny Connecting Services in accordance with these Website Terms & Conditions.

Any rights to the Platform not expressly granted in these Website Terms & Conditions shall be considered as reserved by us.

Platform features may be restricted if you choose to use/ browse the Platform without registering for Nanny Connecting Services.

The license we grant you prevents you:
i. to download or modify any content, or any portion of it, except with prior written consent from us;
ii. to use any robots, data mining or similar data gathering and extraction tools;
iii. from any derivative use of the Platform or any resale use of the Platform;
iv. to transfer viruses, trojans or other features that may contaminate the Platform;
v. to make any false, fraudulent or speculative reservation or post or listing, transmit any unlawful, infringing, defamatory, threatening, indecent, obscene, pornographic or profane material, comment or content that may constitute or encourage a criminal or civil offence, or otherwise violate any law;
vi. to take screenshots of any content on the Platform and disseminate such screenshots in any manner whatsoever; and
vii. to copy, reproduce, duplicate, resell or transfer content of the Platform for any commercial purpose without prior written consent from the Platform.

Any commercial use of the Platform is strictly prohibited, including but not limited to usage of the Platform by recruiting or employment agencies.

The Company may reserve the right to restrict or block access and use of this Platform without any notice or liability whatsoever.

You shall be responsible and keep Nanny Genie fully indemnified from all losses, claims, damages, liability, costs and expenses arising in connection with any violation of these Website Terms & Conditions.

2. REGISTRATION AND SUBSCRIPTION

You will be required to register on the Platform and subscribe to Nanny Connecting Services.

The Nanny Connecting Services shall be for your personal use only.

The registration process requires you to disclose the following basic personal information:
(i) first and last name;
(ii) email address;
(iii) a secure password (you may ask the Platform to ‘save your password’ for ease and convenience);
(iv) details of your preferences related to the Nanny you wish to connect with;
(v) neighbourhood of residence;
(vi) contact number; and
(vii) Emirates ID copy.

To subscribe to Nanny Connecting Services, you are required to disclose additional personal information:
(i) Information about your family, including the number of children, their ages, and any special needs they may have;
(ii) employment history of previous nannies you may have had, including any experience you have had with nannies or other domestic workers;
(iii) your preferences regarding the type of Nanny you are looking for, including their qualifications, experience and availability; and
(iv) information related to any transactions or payments made through the Platform.

You must not provide false information or impersonate a person for the purpose of signing up or at any other point of engagement with the Platform, Nanny Genie or the Nannies.

Our commitment to protect your personal data is in accordance with our Privacy Policy.

Your continued use of Nanny Connecting Services is subject to your compliance of the Ethical Considerations and Eligibility Criteria.

It shall be your responsibility to immediately notify us in writing if you lose access to your Account.

Subject to your acceptance/compliance of the Ethical Considerations, the Platform reserves the right to decline your registration or subscription form on reasonable grounds at its sole discretion and without any notice or liability whatsoever.

3. CONNECTING

Once your application has been accepted by us, we use the additional information you have submitted to the Platform to connect you with a suitable Nanny for you and your family. Our recommendations are subject to your submissions and any alterations to your preferences. It is entirely at your discretion whether or not you choose to recruit or hire the Nanny. You may not match, recruit or hire a Nanny on behalf of a third party or for any commercial purposes whatsoever. Nannies matched through Nanny Genie are only for families in the Emirate of Dubai, UAE.

4. PAYMENTS

The fees owing to us may be subject to change from time to time. The fees may be paid on the Platform. Any salary, remuneration, expense, costs or fees relating to employment of the Nanny, including but not limited to application for a visa, medical insurance or Emirates ID, is your sole responsibility and liability. You waive all claims against Nanny Genie in this respect.

Payment of our fees shall be made through legitimate sources, in the currency Arab Emirate Dirham, through the payment gateway provided on the Platform.
All applicable taxes, credit, charges and promotions will be indicated to you prior to making payment.

Payment of fees shall be non-refundable.

The confidentiality of your financial information is protected in accordance with our Privacy Policy.

5. COMPLAINTS AND COMMUNICATION

We are committed to providing you with satisfactory services and therefore welcome your inquiries, feedback and complaints at [email protected] provided always you agree that complaints and feedback arising from Nanny Connecting Services may be acknowledged by Nanny Genie without any obligation to rectify or remedy such complaint, pursuant to the clause ‘limitation to liability’ below.

Nanny Genie will communicate and engage with you via email, including notifying you when you have been connected with a Nanny, send newsletters and receive feedback and complaints.

6. LIMITATION OF LIABILITY

Notwithstanding anything to the contrary to these Website Terms & Conditions, Nanny Genie shall not be liable for any losses, claims, damages, liabilities, costs and expenses arising in connection with
(i) your use of the Nanny Connecting Services;
(ii) caused by your breach of the Ethical Considerations or these Website Terms & Conditions; or
(iii) any third-party claims, including claims by a Nanny.

You acknowledge and agree that the relationship between you and Nanny is independent and separate from the relationship between you and Nanny Genie and that the Platform is solely a discovery platform to match with Nannies based on your preferences, likes and dislikes. All claims and disputes between you and the Nanny shall be settled or resolved independent of Nanny Genie and the Platform.

Nanny Genie makes no warranty, representation or guarantee with respect to Nanny Connecting Services.

Nanny Genie shall not be responsible to perform its obligations under these Website Terms & Conditions in the case of a Force Majeure Event.

Nanny Genie does not assume or hold any liability for any indirect, special, exemplary, incidental or consequential damages under these Website Terms & Conditions. Nanny Genie’s liability if proven in all respects in the aggregate shall be limited to the fees you have paid Nanny Genie in the six (6) months preceding your claim and you agree not to contest this limit.

This clause ‘limitation of liability’ shall survive termination of these Website Terms & Conditions.

7. INTELLECTUAL PROPERTY

The entire content of the Platform including but not limited to text, graphics, photographs, videos, interactive presentations, software, logos, text, arrangements, layouts, designs, trademarks, trade names, confidential information and other intellectual property are our sole and exclusive property or are licensed to us, with all rights reserved and protected by international copyright laws. Accordingly, you agree not to use, disseminate, publish or reverse engineer any content or other intellectual property rights on this Platform without our prior written consent.

8. AMENDMENTS

We reserve the right to change any content on the Platform including these Website Terms & Conditions, Privacy Policy and Ethical Considerations without any prior notice.

The last updated date of these Website Terms & Conditions will be indicated at the bottom of this document. By agreeing to these Website Terms & Conditions you agree to regularly check for any updates prior to using the Platform and be bound by these Website Terms & Conditions as amended.

9. ASSIGNMENT

These Website Terms & Conditions may be assigned by Nanny Genie with notice to you. You shall not assign your obligations under these Website Terms & Conditions to any third-party without prior written consent of Nanny Genie.

10. SEVERABILITY

If any portion of these Website Terms & Conditions are determined by a competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms and conditions, which will continue to be valid to the fullest extent permitted by law.

11. TERMINATION

We reserve the right to terminate these Website Terms & Conditions at any time without notice or liability whatsoever, provided always the clauses that survive termination continue to do so indefinitely.

You may terminate these Website Terms & Conditions by discontinuing your use of the Platform.

Termination of these Website Terms & Conditions will not affect your or Nanny Genie’s accrued rights at the date of termination.

12. GOVERNING LAW

Any dispute between you and Nanny Genie arising out of or in connection with these Website Terms & Conditions, including but not limited to any dispute regarding its existence, formation, performance, interpretation, validity or termination, excluding any claims or disputes arising out of or in connection to Nanny Connecting Services, shall be referred to and finally resolved exclusively by arbitration by three (3) arbitrators in English language and under the rules of the Dubai International Arbitration Centre with its seat in Dubai, United Arab Emirates. The governing law of these Website Terms & Conditions shall be the applicable laws of the Emirate of Dubai and the federal laws of the UAE.
